COVID-19 Level 1 (March 2021)

From 1 March 2021, COVID-19 Alert level 1 is in place. Most normal activity can resume, with precautions and health guidelines followed at all times. Population prepared for an increase in alert levels if necessary.

Movement of persons

68. (1) Every person is confined to his or her place of residence from 00H00 until 04H00 daily.

Mandatory protocols when in a public place

70. (2) The wearing of a face mask is mandatory for every person when in a public place. excluding a child under the age of six years.

(3) No person will be allowed to-
(c) be in any public open space, if he or she is not wearing a face mask.

(4) The prohibition in subregulation (3)(c) shall not apply to a person who undertakes vigorous exercise in a public place, provided that the person maintains a distance of at least one and a half metres from any other person.

Vista Complex COVID-19 Notification

Due to Government’s Disaster Management Act: Regulations: Alert level 3 during Coronavirus COVID-19 lockdown, the Trustees have decided that all persons inside or entering the complex must please wear a suitable face mask – this includes children 6 years and older (see Mandatory Protocol 34(2) on page 3).

We understand that some residents may not be happy with these changes, but we are currently experiencing a second wave of infections in South Africa, and we would like to keep all Vista residents safe during these times.

COVID-19 Level 3

From 1 June 2020 the restrictions will be downgraded to Level 3.

Alert level 3

All persons who are able to work from home must do so. However, persons will be permitted to perform any type of work outside the home, and to travel to and from work and for work purposes under Alert Level 3, subject to-

  1. (a) strict compliance with health protocols and social distancing measures;
  2. (b) the return to work being phased-in in order to put in place measures to make the workplace COVID-19 ready;
  3. (c) the return to work being done in a manner that avoids and reduces risks of infection; and
  4. (d) the work not being listed under the specific economic exclusions in this Table.

SPECIFIC ECONOMIC EXCLUSIONS

  1. Consumption of food and beverages at or in a place of sale, including restaurants retail outlets, convenience stores or informal traders.
  2. On-site consumption of liquor.
  3. Short term home-sharing/letting/leasing/rental for leisure purposes.
  4. Domestic passenger air travel for leisure purposes, until directions with health protocols and social distancing measures are issued by the relevant Cabinet member responsible for transport.
  5. Passenger ships for leisure purposes.
  6. Conferences and events, including sporting events, except as provided for in Chapter 4 of the Regulations.
  7. Personal care services, including hairdressing, beauty treatments, make-up and nails salons and piercing and tattoo parlours, except those categories of services identified in directions by the relevant Cabinet member, in consultation with the Cabinet member responsible for health, as safe to resume, under specified conditions.
  8. Exclusions relating to public transport services as set out in the directions issued by the Cabinet member responsible for transport.
  9. Exclusions relating to education services as set out in the directions issued by the Cabinet members responsible for education.
  10. Tourist attractions, casinos and entertainment activities, except those categories of activities which the relevant Cabinet members, in consultation with the Cabinet member responsible for health, identified in directions as safe to resume under specified conditions.

Movement of persons

33. (1) A person may leave his or her place of residence to-
(a) perform any service, as permitted under Alert Level 3;
(b) travel to and from work;
(c) buy goods or obtain services, except for the goods or services which are excluded in this Chapter;
(d) move children, as allowed;
(e) exercise between the hours of 06h00 to 18h00: Provided that the exercise is not done in organised groups and adheres to health protocols and social distancing measures;
(f) attend a place of worship in the same or another metropolitan area or district within the same province; and
(g) attend a school or learning institution, once these are opened.

(2) A person must when in a public place, wear a cloth face mask or a homemade item that covers the nose and mouth, or another appropriate item to cover the nose and mouth.

(3) No person is allowed to be in a public place, use any form of public transport, or enter a public building, place or premises, if that person is not wearing a cloth face mask or a homemade item that covers the nose and mouth, or another appropriate item to cover the nose and mouth.

(4) Movement of persons between provinces, metropolitan areas and districts and hotspots is prohibited, except for-

(a) persons doing so in the course of carrying out work responsibilities or performing any service permitted under Alert Level 3, provided that such person is in possession of a permit issued by the employer which corresponds with Form 2 of Annexure A;
(b) persons travelling for purposes of-
(i) moving to a new place of residence; or
(ii) caring for an immediate family member: Provided that such person is in possession of an affidavit which corresponds with Form 6 of Annexure A;
(c) members of Parliament performing oversight responsibilities;
(d) learners or students referred to in regulation 34(5) who have to commute to and from those schools or institutions of higher learning during periods when those schools or institutions are permitted to operate;
(e) the attendance of funerals as provided for in regulation 35;
(f) the transportation of mortal remains;
(g) obtaining medical treatment;
(h) persons who are returning to their place of residence from a quarantine or isolation facility; or
(i) any movement permitted under regulation 41.

Prohibition on evictions

36. (1) Subject to subregulation (2), a person may not be evicted from his or her land or home during the period of Alert Level 3 period.

(2) A competent court may grant an order for the eviction of a person from his or her land or home in terms of the provisions of the Extension of
Security of Tenure Act, 1997 (Act No. 62 of 1997) and the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, 1998 (Act No. 19 of 1998): Provided that an order of eviction may be stayed and suspended until the last day of the Alert Level 3 period, unless a court decides that it is not just and equitable to stay and suspend the order until the last day of the Alert Level 3 period.

COVID-19 Level 4

As you know by now, President Ramaphosa’s announcement on 23 April that the country is moving to a graded alert system to contain the COVID-19 pandemic.

In short, the levels will be as follows:

  • Level 5: Drastic measures are in place
  • Level 4: Some activity allowed.
  • Level 3: Easing of some restrictions on work and social activities.
  • Level 2: Further easing of restrictions but maintaining social distancing.
  • Level 1: Normal activities can resume with caution.

Additionally, from 1 May 2020 the restrictions will be downgraded from Level 5 to Level 4 and the question arises, what implications this downgrade will have for residents living in Sectional Title Complexes. While regulations may change from day to day, we wish to highlight the following:

  1. A curfew will be in place from 20h00 to 05h00 each day.
  2. Wearing of cloth face masks will be mandatory when moving out of residence. (also applicable in respect of common property but not in respect of common property/exclusive use gardens.
  3. No public or social gatherings. (no parties with visitors or neighbours – the Trustees have received a complaint from an owner in this regard).
  4. Exercise will be limited (eg. jogging) with public gyms remaining closed.
  5. Food delivering will be allowed subject to the curfew.

Movement of persons

16. (1) Every person is confined to his or her place of residence.
(2) A person may only leave their place of residence to–
(a) perform an essential or permitted service, as allowed in Alert Level 4;
(b) go to work where a permit which corresponds with Form 2 of Annexure A, has been issued;
(c) buy permitted goods;
(d) obtain services that are allowed to operate as set out in Table 1 to the Regulations;
(e) move children, as allowed;
(f) walk, run or cycle between the hours of
06H00 to 09H00, within a five kilometre radius of their place of residence; Provided that this is not done in organised groups(3) Every person is confined to his or her place of residence from 20H00 until 05H00 daily, except where a person has been granted a permit to perform an essential or permitted service as listed in Annexure D, or is attending to a security or medical emergency.

The following will only be allowed at Level 3:

  1. Garden service and pool contracting.
  2. Commercial real estate.
  3. Recycling.
  4. Walking, jogging and cycling.
  5. Curfew still in place.
  6. Public gatherings are still prohibited.

The return to work of household employment will be allowed at Level 2 but the curfew will remain in place and gatherings still prohibited.

Please keep in mind that some residents will be returning to work and that schools will be reopening in May and that there will consequently be more movement on common property.

Although it is understood that schools will provide the first two masks and sanitizers at school parents are advised to obtain extra masks of the correct make and size for the kids and in the meantime, seek for your convenience, small containers for sanitizers which kids can use regularly while at school.
