1. TENANTS AND VISITORS
1.1 All tenants of units and other persons granted rights of occupancy by any owner of the relevant unit are obliged to comply with these rules, notwithstanding any provision to the contrary contained in any lease or any grant of rights of occupancy.
1.2 Owners and tenants are responsible for the behaviour, acts and omissions of their visitors and shall ensure that such visitors are made aware of, understand and conform to these rules.
1.3 Non-resident owners are responsible for the behaviour, acts and omissions of their tenants or any other person or persons to whom occupation has been given; also visitors of such tenants or such other person or persons.
1.4 Non-resident owners shall further ensure that the tenants and persons referred to in Rule 1.2 are made aware of, understand and conform to these rules, and shall secure from the said tenant or from the said person or persons to whom occupation has been given, as the case may be, an undertaking in writing that such tenant or person(s) shall duly observe all relevant rules and conditions. Such undertaking shall be on such terms and lodged in such a manner and at such time as the Body Corporate may from time to time decide and require.
2. ACCESS FOR REPAIRS
An owner must permit any person authorized in writing by the Body Corporate, during reasonable hours and on notice (except in emergency, when no notice is required), to enter his or her section or exclusive use area for the purposes of inspecting and maintaining, repairing or renewing pipes, wires, cables and ducts existing in the section and capable of being used in connection with the enjoyment of any other section or common property, or for the purpose of ensuring that this Act and the rules are being observed.
3. ENTRY BY THIRD PARTIES
In the interest of security, residents are requested to notify the caretaker timeously in advance of third parties who may from time to time be authorised by them to enter their premises to effect repairs, deliver or take away goods, etc. In the event of such advice not being given, the caretaker may refuse to facilitate entry.
4. INFLAMMATORY GOODS AND SAFETY OF PROPERTY
4.1 An owner/tenant shall not store any material, or do or permit or allow to be done, any other dangerous act in the building or on the common property which will or may increase the rate of the premium payable by the Body Corporate on any insurance policy.
4.2 An owner/tenant shall not store or harbour upon the premises any goods which may vitiate any fire insurance policy held by the Body Corporate, or increase the premium payable in respect of such policy, nor shall the owner/resident do or permit to be done in his section or on the common property, anything which will or may increase the rate of the premium payable by the Body Corporate on any insurance policy.
4.3 No fireworks, crackers or explosives may be brought into the complex.
5. NUISANCES
Owners/tenants shall not cause or permit any disorderly conduct of whatsoever nature upon the premises, or do or permit any act, matter or thing in or about same, which shall constitute or cause a nuisance or any inconvenience to the servants employed by the Body Corporate, to the Body Corporate, or to any other occupant of the premises.
6. SILENCE
6.1 No excessive noise, to the discretion of the Trustees, may be generated at any time in a section or on the common property.
6.2 Hobbies and other activities that cause excessive noise are prohibited.
6.3 Motor hooters may not be used on the common property except as a warning or case of emergency.
6.4 Radios, televisions, musical instruments and record players must be used in such a manner so as not to disturb other residents.
7. CHILDREN
7.1 Owners/residents must supervise and control their children and their visitors’ children in order to avoid damage to the common property or inconvenience and distress to other residents.
7.2 Owners/residents must ensure that their children do not tamper with electrical switches, taps, garden items, or the gate motors/sensors.
7.3 No ball games are permitted on the common property.
7.4 Children may not play games on walkways, ring doorbells needlessly or engage in other irritating practices or nuisances.
7.5 Children are not allowed to play around any vehicles in the complex including vehicles parked in the carports.
7.6 Children may not cause any damage to the gardens, plants or flowers.
7.7 Children under 12 are not allowed on the common property without adult supervision.
7.8 The parents of any child caught damaging gardens or doing any other damage to Vista property or to vehicles, security cameras, fibre boxes or fire extinguishers will be liable to replace, repair or pay for damages.
