22. ERADICATION OF PESTS

22.1 An owner shall keep his or her section free of mice, rats, white ants, borers and other wood-destroying insects and to this end shall permit the Trustees, the managing agent and their duly authorised agents or employees to enter his or her section from time to time for the purpose of inspecting the section and taking such action as may be reasonable necessary to eradicate any such pests.

22.2 The cost of the inspection eradicating any such pests as may be found within the section, replacement of any woodwork or other material forming part of such section which may be damaged by any such pests shall be borne by the owner of the section concerned.

23. BRAAI FACILITIES

23.1 Open fires or braais are only allowed in the designated braai area.

23.2 Use of the braai area may not cause a disturbance for other residents and may not be used after 22:00.

23.3 It is prohibited to braai in the gardens or spaces in front of the units, the patios and pathways.

24. OCCUPATION OF SECTIONS

The number of residents per unit shall not exceed two persons per bedroom.

25. NEW RESIDENTS OR OCCUPATION

25.1 All new residents shall ensure that the Body Corporate is notified in a timely manner when moving in. An access control form must be filled out, which can be obtained from the Caretaker. An undertaking to comply with the conduct rules, also on this form, must be signed.

25.2 It is the responsibility of the owner or nominated agent or representative to ensure that the new resident receives and understands the conduct rules.

26. MUNICIPALITY BY-LAWS

All applicable municipal by-laws will apply to the complex and Body Corporate, therefore all residents and visitors to the complex shall adhere accordingly.

27. FINES

If the conduct of an owner or an occupier of a section or his visitors or guests constitutes a nuisance in the opinion of the trustees, or if an owner, occupier or visitor contravenes, breaches, disobeys or disregards a Management or Conduct Rule, the trustees may furnish the owner and occupier with a written notice which may in the discretion of the trustees be delivered by hand or by email. In the notice the particular conduct, which constitutes a nuisance, must be adequately described or the Rule that has allegedly been contravened must be clearly indicated, and the offender must be warned that if he or she persists in such conduct or contravention, a fine will be charged to the levy account of the owner of a section.

The penalties relating to the following rules are summarized as follows:

  • Rule 1 TENANTS AND VISITORS: R500 per incident
  • Rule 2 ACCESS FOR REPAIRS: R500 per incident
  • Rule 3 ENTRY BY THIRD PARTIES: R500 per incident
  • Rule 4 INFLAMMATORY GOODS AND SAFETY OF PROPERTY: R5,000 per incident
  • Rule 5 NUISANCES: R500 per incident
  • Rule 6 SILENCE: R500 per incident
  • Rule 7 CHILDREN: R500 per incident
  • Rule 8 MOTOR VEHICLES AND PARKING: R500 per incident
  • Rule 9 BICYCLES, MOTOR CYCLES, ETC: R500 per incident
  • Rule 10 LAUNDRY: R500 per incident
  • Rule 11 RUBBISH DISPOSAL: R500 per incident
  • Rule 12 PETS: R500 per incident
  • Rule 13 DOMESTIC WORKERS: R500 per incident
  • Rule 14 BUSINESS AND OTHER ACTIVITIES: R1,000 per incident
  • Rule 15 APPEARANCE FROM OUTSIDE: R1,000 per incident
  • Rule 16 INTERIOR: R500 per incident
  • Rule 17 EQUIPMENT AND INSTALLATIONS ON THE COMMON PROPERTY: R5,000 per incident
  • Rule 18 GARDENS AND LAWNS: R500 per incident
  • Rule 19 DAMAGE, ALTERATIONS OR ADDITIONS TO THE COMMON PROPERTY: R5,000 per incident
  • Rule 20 LITTERING: R500 per incident
  • Rule 21 SIGNS AND NOTICES: R500 per incident
  • Rule 22 ERADICATION OF PESTS: R500 per incident
  • Rule 23 BRAAI FACILITIES: R500 per incident
  • Rule 24 OCCUPATION OF SECTIONS: R5 000
  • Rule 25 NEW RESIDENTS OR OCCUPATION: R500 per incident

Prior to the imposition of a penalty for alleged transgression of a rule, the Trustees must afford the alleged transgressor the opportunity to be heard regarding the transgression. This notification period between parties shall be in writing and will be 14 business days. Should the owner/tenant not be satisfied with the decision of the trustees, he/she may approach the Community Schemes Ombud Services to resolve the dispute.
